Jairam Ramesh, environment, Vedanta and Odisha
Alleged rogues, Anil Agarwal, Bauxite, Bhubaneswar- Cuttack- Puri, ENVIRONMENT, EXPOSING ANTI-ODISHA-GROWTH SCHEMES, Forestization, Kalahandi, Key Center-State issues, Koraput, Malkangiri, Mine related pollution, Nabarangpur, Puri, Vedanta August 17th. 2010, 2:12amPeople reading this blog must must have seen the news about the Saxena committee (which was empowered by Jairam Ramesh and the environment ministry) report on Vedanta’s operations in Lanjigarh, Odisha.
Although the report reads like an activist team’s report, the fact remains that the laws of the country are sacred and needs to be followed.
It is a different matter that laws are broken with impunity at all levels ranging from the laws reported to be broken by Vedanta to normal people extending their houses and gardens into government land, groups building temples as a ruse to capture government land where ever they feel like, people blocking roads, trains, doing bandhs whenever they feel like, etc. etc. In India laws are broken with impunity and are broken more often than they are adhered to. But this does not excuse what Vedanta is reported to have done. The committee report also rebukes the Odisha government for its hand in the whole affair.
However, one needs to put this report in perspective with what the environment ministry and Jairam Ramesh have found in rest of India. Following are excerpts from a report in rediff.in that gives us some added perspective.
… several industrialists are also upset about what they call Environment Minister Jairam Ramesh’s activist-like positions. "He is taking positions, which are normally associated with unreasonable activists and their organisations," says one leading industrialist whose project is stuck. …
… Data from the ministry’s website show that of the 58 projects that have come up for Coastal Regulation Zone clearance since April 2009, it gave only half a dozen of them the green signal.
Over 1,800 projects are awaiting clearances as of the first week of this month.
…"There are people who consciously instigate and organise people in coastal Andhra against projects coming up in the region," says a spokesperson of a power company, which is promoting a project in coastal Andhra Pradesh.
"Land availability is a big issue in India. Developers can approach the ministry only after either acquiring the land or have assurances to get the land, to request for the terms of reference to carry out an Environmental Impact Assessment study. By that stage, a lot of investment and time may have gone into execution of the projects, and still you are not sure of getting the clearance," says Sanjay Sethi, executive director (infrastructure) at Kotak Investment Banking.
"It is necessary to have more transparent and clear guidelines and checklists for land available for various commercial and industrial uses, with clear maps of sensitive zones, which should be easily available to project developers," he adds.
… To be fair to the environment ministry, there are issues like misrepresentation of facts by project developers and the state, or conflicting reports on issues by expert panels.
In a recent development, the environmental clearances for at least four projects in an around Srikakulam in Andhra Pradesh were suspended by the ministry.
On July 15, the ministry cancelled the clearance given to Nagarjuna Construction Company’s 2,640 megawatt (Mw) coal-based super critical thermal power plant at Gollagandi and Baruva villages in Srikakulam.
An expert panel said most of the project land allocated by the state government might be regarded as wetland, contrary to an earlier panel report that the 750 acres of grasslands were barren and not fit for agriculture.
The same expert panel, which visited East Coast Energy’s 2,640 Mw thermal project near Kakarapalli village in Srikakulam during the same time, found the state government had ignored reports on the ecological value of low lying areas of the well recognised Naupada swamps wetland and migratory bird breeding in nearby Telineelapuram of Srikakulam.
"This amounts to suppression/distortion of facts," the panel said.
A nearby project – that of JSW’s 1.4 million tonnes per annum (MTPA) alumina refinery and a co-generation plant – is also being reviewed by the ministry.
… On June 28, the ministry directed the formation of a supervisory committee to monitor the influence of toxic effluents from JSW Energy’s 1,200 Mw thermal power plant at Jaigad in Maharashtra, following apprehensions that effluents could affect the quality of Alphonso mangoes and cashew orchards in the region.
… Ten days before that, Jindal Power Limited drew the wrath of the ministry for commencing construction of a 2,400 Mw power project at Tamnar in Chhattisgarh, without obtaining prior environment clearance.
The ministry has directed the state government to stop work and initiate action against the Naveen Jindal-promoted company.
Some of the other high-profile projects that have been halted include the Maheshwar Hydroelectric project on the Narmada river in Madhya Pradesh on grounds that the conditions of the statutory environmental clearance were not complied with and the resettlement and rehabilitation of the project-affected families was less than satisfactory – charges denied by the state chief minister and the company.
… Also, many say the minister has involved himself in much-publicised wars of words with Civil Aviation Minister Praful Patel over the environment ministry’s reluctance to clear the Navi Mumbai international airport, citing destruction of mangroves, razing of a hill and diversion of two rivers; with Road Transport Minister Kamal Nath, who openly accused him of blocking projects;
… But, even his sharpest critics agree on one thing: Ramesh has made sure that no one can treat the environment ministry lightly any longer.
… "This is probably the first time that an environmentalist has become a minister. He is almost single-handedly bringing about a paradigm shift within the government about how to view progress and development," says Pandey.
I agree with the sentence in the red. Earlier companies and state governments were not taking the environment ministry that seriously. Ramesh’s actions will make sure that everyone take the environment ministry seriously. That is a good thing and kudos to Mr. Ramesh for that.
However, as far as Odisha is concerned Jairam Ramesh seems to have something against it. We say that for the following reasons.

- Recently, Hindustan Times (see http://www.hindustantimes.com/Environment-Ministry-puts-on-hold-Vedanta-University-in-Orissa/Article1-542363.aspx) reported the following: "The Union Environment Ministry on Tuesday put on hold the controversial Rs.150 billion Vedanta University project in Orissa following complaints of alleged irregularities by its promoter Anil Agarwal Foundation. The direction to keep the project in abeyance has come within a month of the Ministry granting conditional environmental clearance to the Foundation which is building the university." Now stopping a mine or a factory or an airport for environmental reasons may make sense, but a university?? That too, just because some one complained. No investigation! Just people complained and he stopped the project, when the project was about to construct a medical college!!
- Jairam Ramesh and his ministry recently granted environmental permission to construct the Polavurum dam in Andhra Pradesh against the objections of the Orissa and Chhatisgrah government. See http://timesofindia.

It wrote: "Oddly, while the ministry had set up separate committees to investigate the settlement of rights under the Forest Rights Act in other high profile cases such as Vedanta and Posco which propose to displace far lesser people, in the Polavaram case the ministry has decided to accept the state government’s compliance report on face value. The mega-project is expected to submerge 276 villages displacing upwards of two lakh people by some estimates. "
In summary, while Jairam Ramesh deserves kudos for putting his foot down on environment laws and making sure everyone takes them seriously, people of Odisha need to be very careful of him as he seems to be against Odisha; he has stopped projects clearly beneficial to Odisha (namely, Vedanta University) by using his environment stick, and at the same time has allowed projects clearly harmful to Odisha (namely, the polavurum dam) even after the Odisha government and Odisha chief minister have vehemently objected to it. This does not at all gel with the actions they took against Vedanta University. There the project was ordered to stop because some people complained. Here the project was given green signal despite the state of Odisha and its chief minister complaining and that too reportedly without any enquiry.

I accept the view in the red line. But this bloody minister is acting like a dictator. Is he the god of all approvals? When all the states exploited the environmental laws nobody was there and when in Odisha something is coming up he is standing there. If he is very much concerned about the environment then how come he approved Pollavaram project against the wishes of Odisha. The only reason, he belongs to the same area. I accept that environmental issues should be addressed in a better manner but not impractically and not at the cost of development. Regarding the POSCO issue, how many tribal people are living there? What is the forest coverage there? I belong to the vicinity of the area and not a single tribal is living there. The area was never having any forest canopy but having some wild bushes. This man has found a new place to execute his fantasy rather than caring for the environment. Just ask him how many saplings have been planted since his tenure at the same portfolio. I am sure he would not having that date with him.

I completely agree with the comment made by the gentleman above. The bogey of forest area near the Posco site is being raised by the environment ministry just to suit it’s purpose.
Moreover, suddenly as a nation we seem to have woken up to corruption! It would be naive on our part to believe corruption was non-existent. At every level our nation is corrupt, and yet we want Vedanta to behave differently (Almost as if to suggest that they should be true to their name). Reports mention that the company colluded with the administration and the government. The minister and his ministry should be asked for the name of one major project in independent India where this has not happened. Files will not move without facilitation fees, party contributions, regardless of which party is in power.
Yes we must have concern for the environment. There are no two ways about it. But let the concern not be selective.

I am agree with you mr. sarangi.Not only jayram ramesh but also the central govt is against the development of odisha.They have not learn alesson from 2009 general election.They are denied by people.If they behave like this towards odishawe the people of odisha will teach them another lesson.They are well known about their position in odisha.

I completely support the action of Shri Jayaram Ramesh. Naveen babu has given the land of Jagannath Mahaprabhu in free, I do not understand why there is so much favour from BJD govt. towards Vedanta. Is it because relatives of ruling elite of Orissa are staying in vicinity of Sterlite owner? In Lanjigarh the violation of rules can be clearly seen. At that time there was no action, now there is action. One gets what he gives to the world.

Mr. Panda, we are not here to support any political party or any particular government. We are supporting the greater cause of development of Odisha which might be done by any able leader from the state. I support Naveen Pattanaik govt. for executing the projects in Odisha and making it the most favoured state in India for deployment of investments, kicking back Gujarat and Maharastra (Economic Times). Not only that I had written in my earlier comment how Mr. K P Singhdeo and Mr. Kanhu Charan Lenka, both congress leader, doing a lot for Odisha. So the point here is not personification but development. We have seen the days when our great Biju babu was literally begging for the second steel plant to the GOI and Caparo group.
Secondly, it seems that you are smitten by some conservative ideas. What the people or govt. of Odisha were doing with the land of Lord Jagannath. Nothing for thousand years. When something is happening here to place Odisha in the world education map we are opposing it for the sake of opposing it. No valid logic. If you have gone through the bill passed by the assembly, it clearly says that the land is provided only for the purpose of making the Vedanta university. If that could not be executed for any reason whatsoever then the same will be returned to the Sri Jagannath Temple Administration.
This is the high time let us be united and practical in our approach for the development of Odisha in-toto. There is no coastal Odisha, no western Odisha nor southern Odisha. My hearty appeal to all, Please be united.

I agree whole heartedly with Sameer Panda, Let some one come and see in Lanjigarh. Or else please see the report of NC Saxena Committee in the web. How touching the report is. The allegations/findings of Saxena Committee is 100% also more things have not even published in the same reports. How the rules and acts has been sidelined just to favour Vedanta. It is pitiable. How the corrupt politicians do favour to MNCs. just for some illegal-gratifications. Alas, let God Jagananth Save Odisha. Days were there, when poeple started to establish college/schools people from all communities come forward to donate in shape of cash/kind land etc. But now, some one going to establish a world class Univ. but the opposers are many and supporters are a few henchmen of Politicians. Strange scenario. Is not it..? The person who is going to establish Univ at Gajapati was opposed by no body. Since he has already setup a College(JITM) to show the example of his honesty. What about POSCO & Vedanta ? They want their profit only. Let the people in and around plant area go to hell. The State Politicians are giving views staying from a distance place at Bhubaneswar. No one is realising the ground reality. What a sorry state of affairs. Why common poeple will believe Politicians?

First it was Mr. Arjun Singh as HRD minister who played dirty politics to deny orissa it’s due in HRD budget now we have Mr. Jayaram Ramesh who is putting roadblocks to all high profile projects in orissa. Posco and Vedanta university projects comes once in a century and if implemented as per plan can change the landscape of orissa in terms of socio-economic development. The congress party in orissa does not have any face till last few dacades and it tries this dirty politics now to revive the party. They probbaly forget that they can not fool us and people are very much aware of it’s real intentions. congress will not have a chance for next 10-15 years in orissa if it continues it’s step motherly attitute towards orissa. I just hope that the roadblocks are removed at the earliest and orissa does not loose on posco or vedanta university projects.

Sarangi babu must be smitten himself, by a sense of development via mining, which is considered plain HORRIBLE elsewhere. And that too with companies like Vedanta, with an awful track record of bending rules. About “clearly written Bills passed in Orissa Assembly”, Mr Sarangi seems to be clearly bamboozled. If things were this straight, there would be a land surfeit now.
Incoming investment figures charm many people. Particularly those who see a personal profit in it. But it is outrageous to drum up support in guise of patriotism!

Dear friends, I firmly believe that their is nothing for having a ‘for Odisha’ or ‘anti Odisha’ debate here. Dr Saxena is a highly respectable figure of impeccable credentials. And the environment ministry is merely following the rules in a honest manner, which was lacking previously. Jairam Ramesh may have, rather has, erred in giving the go ahead to Pollavaram. But such go aheads were also given for Vedanta also. So, we should rather protest Ramesh’s decision of giving the go ahead to Pollavaram and force him to cancel that than engaging ourselves in a bogus debate on whether he is pro Odisa or anti Odisha.

Good that Dr. Baral thinks that the rule of law should be followed. As Bimal points out, we should take Jairam Ramesh to task for not following the same standards for Polavaram as for Vedanta and POSCO. Please read the Saxena report – it is legally, procedurally and ethically in the right, and what we should aspire for is the same standards for all development projects as well as investments. My friends talk as if investments in extractive industries is the same as attracting investments for software development. Maybe they need to examine the histories of extraction zones more carefully, and today, in an age when global capital has almost unfettered capacity to move around merrily, being rich in natural resources is a curse. You either end up like Iraq or Nigeria, ruled by force so that extraction proceeds smoothly or you end up like Congo, where warlords fight over the spoils. See the state of Lousiana in Dr. Baral’s US, a literal playground of the oil producers and refiners. Orissa is the extraction zone for a fast growing India and China, as well as the rest of the world, and our friends see this process of extraction, which leaves behind destroyed landscapes and people- as development. Development for whom? For those of us who need cars and airports? In an age of global warming and ecological limits, do people really think that all people in Orissa can be rich and own cars. No sir, a majority of people will have to sacrifice their livelihoods and environment, so that a minority can live in luxury. The model of development being exported to us- of neoliberalism- has wreaked havoc even in a democratic country like USA- what it is doing in India, one can see everyday. Vedanta seems to be running the state, and voices raised against it have been brutally repressed. It is the spaces of democracy within the Indian system, inspite of all the corruption and co-option, that the NC Saxena report, and more important the FRA, has become possible.

Unfortunately, many activists opposing Vedanta in Niyamgiri have singled this company out. NALCO also does the same kind of (mountain top) mining close to that area. Why is it ok for NALCO to mine? (Don’t tell me that the mountain NALCO mines from was a useless mountain and not used by the people dwelling there.)
Also, the same people oppose Vedanta University. Why? Also, many of the same people support or condone all other kinds of unlawful activities like Bandhs, blocking of public roads, attacking and killing policemen, kidnapping, etc. Why? Why?
If epgorissa believes investment in software development is something good, then he should be supportive of investment in higher education which is a catalyst for many kinds of non extractive investment.
My conclusion so far is that opposing anything associated with Vedanta is personal to many and if in the process Orissa is harmed or Orissa remains at the bottom of every parameter, they don’t care. They are happy that they scored a point.

CB: you can see how odia people are very unfortunate from the above discussions. we never reach a conclusion. we expect others to help and do it for us. In fact no one cares for odisha, neither odias nor others. All the people of odisha should realise that Naveen Pattnaik and BJD has got overwhelmingly won election ie received clear mandate from the of the people living in the state …. and not many parties in the country has got that. therefore we should believe in him and support him. we can see how the land issue got related to lord jagannath and things like that always happens and this why “we are odia and were behind, are behind and will be behind everybodyelse ….. always below the poverty line”. A govt ca’t do things on its own, it needs support from people and that is just not there.
